Our
View: Law, bad for state
Already
the bosses are taking a little more ground
in the battle between the businesses and
the employees. Companies are due to celebrate
a ruling that would free businesses from
liability of a supervisors actions towards
an employee if a claim of sexual harassment
was taken first to the courts, rather than
making a formal complaint.
This
may seem minor enough, but an employee who
believes his or her superiors will not take
action and instead goes to the court could
lose out altogether on a settlement or decision.
This could mean many employees who have
their complaints in the process right now
could lose all claims to retribution.
This
is just another step in the wrong direction.
Admittedly, false claims and the obsession
with suing in this state could stand at
odds with real justice. But by making going
through the company the only way to handle
it we could go back to a time when the women
are blamed for any advances and become to
scared of confronting the issues. This could
become a major backpedal in the drive towards
a more egalitarian workplace.
Regulations
on the amount of litigation could be beneficial
in some cases, Americans are sue-happy for
sure. But before we take the victims rights
away, we should make sure we're not doing
it because the companies don't want to lose
any money, we should make sure its for the
right reason.
