Proposal puts limits on all Cal State student smokers

At the recent California State University Board of Trustees Committee meeting, the committee discussed a regulatory change that would give campus presidents the authority to enact smoking polices on campus.
 
This change would provide campus presidents authority to extend second-hand smoking policy to all individuals, including members of the public, said Jackie R. McClain, vice chancellor of Human Resources for the CSU system.
 
Currently, state law prohibits smoking in campus buildings and in outdoor areas within five feet of main entrances and exits. A student group known as C.O.U.G.H. (The Campuses Organized and United for Good Health) has asked that smoking be prohibited at least 20 feet from all campus buildings. The board will vote on adding Section 42356 to Title 5, California Code of Regulations in September.
 
Section 42356 would delegate authority to campus presidents and the chancellor to adopt rules regulating smoking on campuses and properties of the CSU. The purpose of the regulations would be to mitigate exposure to second-hand smoke in the universities. Notice of smoking regulations would be posted at principle entrances to the CSU campuses.
 
If the Board of Trustees add Section 42356 to Title 5, every person who violates or attempts to violate the rules would be guilty of a misdemeanor, McClain said. Since there may be negotiable impacts to represented employees from any rule adopted by a campus, notice of the rule would need to be given to the employee unions before implementation of the rule.
 
A public hearing concerning this proposed change will be held at 9 a.m., Sept. 18, in the Glenn S. Dumke Conference Center at 401 Golden Shore, Long Beach. Anyone interested may present oral or written statements pertaining to the change at the hearing. Written comments must be received by the close of business on Sept. 18 addressed to Bruce M.
